Empiris Kaidah Hukum Menurut Lawrence Meir Friedman yang menyatakan bahwa:

“The legal system is not a machine, it is run by human being”.

(Sistem hukum bukanlah mesin, melainkan dijalankan oleh manusia).

Selain itu, Lawrence Meir Friedman juga menyatakan bahwa paling tidak ada tiga komponen yang cukup dominan yang mempengaruhi proses penegakan hukum, yakni:

Komponen structural dalam hal ini adalah bagian yang tetap bertahan, bagian yang memberi semacam bentuk dan batasan terhadap keseluruhan.
Komponen Substansi disini dimaksudkan sebagai aturan, norma, pola perilaku nyata manusia yang berada pada sistem tersebut (komponen structural), mencakup keputusan yang mereka keluarkan, aturan baru yang mereka susun.
Komponen kultural atau budaya hukum, dalam hal ini sikap manusia dan system hukum, kepercayaan, nilai pemikiran serta harapannya.

BIOGRAFI

Lawrence Meir Friedman adalah seorang profesor hukum, sejarawan, ahli sejarah hukum Amerika, dan penulis buku-buku nonfiksi dan fiksi. Ia lahir pada tanggal 2 April 1930.
